Sometimes the systems overlap, but claiming both for the same dates can create a serious consistency problem.
When checks stop, rent still comes due. It is normal to look at EDD while a workers' comp claim is delayed, denied, or confusing. The risk is that each system asks a different question.
Workers' comp asks whether a work injury caused wage loss or medical need. Unemployment asks whether you can work, are available for work, and meet EDD rules. Those statements can clash.
This page explains the conflict in plain terms. It also covers light duty, overpayments, and the records to compare before applying.
Temporary disability often says injury keeps you from working, while unemployment often requires that you can accept suitable work.
Temporary disability is tied to medical work status. A doctor may say no work. The insurer may then owe wage benefits if the claim and wage loss requirements are met. Labor Code 4656 sets key limits on many temporary disability periods.
Unemployment uses a different test. EDD may ask if you are able and available for work. If you certify that you can work with no limits while medical reports say no work, the records may collide.
The problem may not appear right away. It may appear later when EDD, the carrier, a defense lawyer, or a judge compares forms.
| Temporary disability weekly rate | 2025 | 2026 |
|---|---|---|
| Minimum | $252.03 | $264.61 |
| Maximum | $1,680.29 | $1,764.11 |
Light duty can mean you are not fit for the old job, but may be able to accept work within restrictions.
A light duty note changes the discussion. You may be able to work, but only with limits. The limits might involve lifting, standing, reaching, driving, tools, hours, or pace.
If your employer has suitable modified work, workers' comp wage benefits may change. If the employer has no suitable work, wage loss may still be tied to the injury. The exact duty offer matters.
EDD forms should match the restrictions. Do not say you can do any job if the doctor says you can do only restricted work. Keep a copy of the work status note beside each EDD certification.
Yes. EDD can seek repayment if later records show that benefits were paid for weeks that did not qualify.
An overpayment notice can come after the money is gone. It may arise because medical records show no work capacity. It may arise because workers' comp later paid wage benefits for the same period.
Do not ignore an EDD notice. Calendar the response date. Save the envelope, notice, proof of mailing, and all weekly certifications. Ask for legal advice if the weeks overlap with workers' comp temporary disability.
Some workers may need State Disability Insurance instead of unemployment. That is also an EDD program, but it is not the same benefit. The correct path depends on medical status and claim payments.
| Work status | Main risk | Practical step |
|---|---|---|
| No work | Unemployment availability may conflict | Ask before certifying availability |
| Restricted duty | Forms may overstate ability | List the same limits shown by the doctor |
| Modified job offered | Duty list may not match restrictions | Keep the written offer and medical note together |
| Claim delayed | Benefits may overlap later | Track dates and payment sources by week |
The insurer may use conflicting forms to argue that the worker is unreliable about disability, work ability, or wage loss.
Credibility matters. A defense lawyer may ask at deposition whether you applied for unemployment. The adjuster may request EDD records. A judge may compare what you told each system.
Small differences can be explained when the facts changed. For example, a doctor may move a worker from no work to restricted work. The dates need to be clear.
Do not hide the comp claim from EDD if a form asks about injury, disability, payments, or work limits. Incomplete answers can create repayment and credibility issues.
Collect work status notes, benefit notices, pay stubs, EDD forms, and modified duty offers before certifying work ability.
Before applying, line up the dates. Put medical status next to each week. Add workers' comp checks, missed checks, EDD payments, employer wage payments, and any job offer.
If the claim is denied or delayed, keep the denial letter and any EDD notice. If the doctor changes restrictions, save the new note. If the employer says no modified work exists, ask for that in writing.
When answers are unclear, pause. A short legal review can prevent a costly overpayment or a credibility issue in the comp case.

Yazdchi Law reviews California workers' comp benefit issues for workers in matters connected to Van Nuys, Los Angeles, Long Beach, Pomona, San Bernardino, Riverside, and Oxnard WCAB venues. EDD forms are statewide, but the comp case still needs careful local handling.
Bring the work status notes, EDD paperwork, benefit notices, and pay stubs. A clean weekly chart helps. Put the doctor's status beside each EDD certification and each workers' comp payment. If one week changed from no work to restricted work, mark the exact date of the change.
Local workers often face the overlap after a layoff, plant closure, reduced schedule, or no modified duty offer. The reason matters. A worker who can do restricted work may answer EDD questions differently from a worker with a total off-work note. The forms should not be guessed under financial pressure.
If an EDD overpayment notice arrives, save the envelope and the full notice. Do not throw away pages that look generic. The appeal date may appear on one page, while the reason may appear on another. If you already certified weeks with EDD, print or save each certification. Do not rely on an online account staying available. Compare each answer to the medical note for that week. If a mistake appears, ask for advice before trying to fix it alone.
When the comp carrier later sends a payment notice, check whether it covers the same dates as EDD. Overlap is easier to address when dates are found early.
If EDD asks about a job search, keep searches limited to work you can honestly perform. Save the job title, duties, date, and any restriction that mattered. This protects both the EDD file and the comp credibility record.
If an online EDD screen does not let you explain restrictions, save a screenshot and keep a written note of what you meant. A later explanation is easier when you can show the limited choices the form gave you.
Bring the chart to any benefits review.
Dates matter more than labels.
Save each notice.
